**Full-Service, Limited-Scope / Unbundled Options

As a full-service law firm, Access Legal Care of course offers traditional, full-service representation, including attending all hearings, negotiating with the opposing party/attorney, preparing all documents throughout the case, and providing legal advice throughout. This type of service is what most typical law firms offer exclusively, and it often requires a large up-front retainer agreement in the several thousands of dollars. At Access Legal Care, we do offer full-representation, but our up-front fees are much lower, we often can break the retainer into smaller, more manageable payments over 2-3 weeks, and then we offer a weekly payment plan after that.

Unlike many traditional law firms, Access Legal Care also offers limited-scope / unbundled legal services. Unbundling, or limited scope representation, is an alternative to traditional, full-service representation. Instead of handling every task in a matter from start to finish, the lawyer handles only certain parts and the client remains responsible for the others. This allows clients to get expert legal advice and representation on a “pay as you go” or “flat-rate” basis, spending only hundreds of dollars for each step, rather than being required to come up with a much larger up-front retainer.

Arbitration Services

Access Legal Care Attorneys represent clients in Arbitration Actions. Arbitration is a private process where disputing parties agree that one or several individuals can make a decision about the dispute after receiving evidence and hearing arguments. When arbitration is binding, the decision is final, can be enforced by a court, and can only be appealed on very narrow grounds. There are two types of arbitration actions in which Access Legal Care Attorneys can help: 1) Standard Arbitration (usually court-ordered or contracted-for), and 2) Christian Arbitration Services resolving a dispute between two Christians, which is a free service.

Standard Arbitration Services. Typical arbitration that most people may be involved with is that which the parties either agreed by contract that they would engage in arbitration prior to or in lieu of filing any court action against one other, or that is ordered by a Judge. This type of Arbitration is usually performed under rules set by an organization such as the American Arbitration Association (AAA), arbitrated by professional neutral arbitrators, and the decision of the Arbitrator(s) are often binding on the parties. We represent clients who are submitting their case to arbitration. We charge affordable legal fees for doing so, plus the Arbitrator(s) also charge a fee.

Christian Arbitration Services. Access Legal Care also provides a very rarely-offered type of arbitration services which is biblically based, led by a Christian attorney, and is intended to help resolve disputes between two Christians.

This service is based on the biblical passage in 1 Corinthians 6:1-7, which says: “Dare any of you, having a matter against another, go to law before the unrighteous, and not before the saints? 2 Do you not know that the saints will judge the world? And if the world will be judged by you, are you unworthy to judge the smallest matters? 3 Do you not know that we shall judge angels? How much more, things that pertain to this life? 4 If then you have judgments concerning things pertaining to this life, do you appoint those who are least esteemed by the church to judge? 5 I say this to your shame. Is it so, that there is not a wise man among you, not even one, who will be able to judge between his brethren? 6 But brother goes to law against brother, and that before unbelievers! 7 Now therefore, it is already an utter failure for you that you go to law against one another. Why do you not rather accept wrong? Why do you not rather let yourselves be cheated?”

In this passage, the Apostle Paul is instructing believers to settle disputes either by: 1) just accepting the wrong, moving on, and letting God deal with it in His own way, or by: 2) appointing “a wise man among you…[a believer and Christian] who will be able to judge between his brethren.” Paul specifically instructs believers to take their matter before other believers, rather than taking another Christian to civil court to resolve a dispute in front of a potentially non-believing Judge, and much to the dishonor of the church before the public.

It is in the spirit of this bible passage that Access Legal Care offers free Christian Arbitration Services to believers who are in a dispute with other believers. Both parties in the dispute must be professed Christians; both parties must voluntarily agree to submit their case to our law firm for these services; and both parties must agree to not sue the other in civil court unless/until there is a failure of resolution at the conclusion of this arbitration service. Neither party will pay any legal fees to us (the service is free), and we will assign an experienced, Christian, licensed-attorney as a neutral arbitrator between the two parties to seek to arbitrate and resolve the dispute.

Bankruptcy Chapter 7 Services

Chapter 7 bankruptcy is the fastest and most common form of consumer bankruptcy. It’s a tool to resolve overwhelming debt under the protection of a federal court. You may have to give up some assets, like an expensive car or jewelry, but the vast majority of filers do not.

This type of bankruptcy forgives most unsecured debts, that is, debts without collateral, like medical bills, credit card debt and personal loans. However, some forms of debt, such as back taxes, court judgments, alimony and child support, and student loans generally aren’t eligible.

To qualify for Chapter 7 bankruptcy you:

Must pass the means test, which looks at your income, assets and expenses.

Cannot have completed a Chapter 7 in the past eight years or a Chapter 13 bankruptcy within the past six years.

Cannot have filed a bankruptcy petition (Chapter 7 or 13) in the previous 180 days that was dismissed because you failed to appear in court or comply with court orders, or you voluntarily dismissed your own filing because creditors sought court relief to recover property they had a lien on.

QDRO/EDRO Retirement Order Services

A “Qualified Domestic Relations Order” (also known as QDRO), and an Eligible Domestic Relations Order” (also known as an EDRO) is a court order used to divide specific types of retirement plans, including qualified and 403(b) plans. According to the Internal Revenue Service, a QDRO is “a judgment, decree or order for a retirement plan to pay child support, alimony or marital property rights to a spouse, former spouse, child or other dependents of a [retirement plan] participant.”

A QDRO grants a person known as the “alternate payee” the right to part of the retirement benefits a former spouse (the “participant”) earned through an employer-sponsored retirement plan. While a QDRO provides benefits to an alternate payee when the participant is alive, it can also award survivor benefits if the participant dies.
